  約束治理者本應是常識

  人(ren)無(wu)信(xin)不(bu)(bu)立(li)(li),國無(wu)信(xin)則(ze)衰(shuai)。社(she)會(hui)(hui)誠信(xin)建設(she)的(de)(de)重要性,理論和實踐(jian)已有(you)說明而(er)無(wu)須過多注解。在一(yi)個全覆蓋的(de)(de)社(she)會(hui)(hui)誠信(xin)體(ti)系(xi)之(zhi)下,自然不(bu)(bu)允(yun)許有(you)不(bu)(bu)受限(xian)制的(de)(de)特殊群體(ti)。農民工也好,公務員(yuan)也罷,作(zuo)為一(yi)個社(she)會(hui)(hui)個體(ti),在權利和義務上完全一(yi)樣(yang),都應為失信(xin)而(er)付出代價,比如就業受到限(xian)制,晉(jin)升面臨(lin)困難。若誠信(xin)體(ti)系(xi)建設(she)不(bu)(bu)能做到起點公平,一(yi)視同仁的(de)(de)話,差別化對待的(de)(de)結果就是暗窗林立(li)(li),無(wu)以為效。

  時下的(de)(de)誠(cheng)信體系建設最(zui)大的(de)(de)瓶頸和障礙在于,運動員(yuan)和裁(cai)判員(yuan)集于一身,形成了(le)事實上的(de)(de)法外之(zhi)地。有(you)選擇(ze)的(de)(de)執(zhi)行,使誠(cheng)信體系成為治理別人(ren)(ren)的(de)(de)手段,而對(dui)于治理者(zhe)卻缺乏必要(yao)的(de)(de)約束。比(bi)如同樣是承諾,若一個(ge)公司職(zhi)員(yuan)對(dui)客戶(hu)的(de)(de)某項承諾沒有(you)兌現(xian),就可能被罰款甚至解聘(pin);而若是一名(ming)公職(zhi)人(ren)(ren)員(yuan),即便在人(ren)(ren)代會上向(xiang)代表們(men)作出了(le)莊嚴承諾,失信了(le)也可能毫發無損。否(fou)則,現(xian)實中(zhong)就不會存在大量的(de)(de)半(ban)拉子(zi)民生工程(cheng)。

  當然,公務員失(shi)(shi)(shi)信(xin)(xin)(xin)的(de)表現很多(duo),比(bi)如(ru)“一(yi)(yi)套班子一(yi)(yi)套人(ren)(ren)馬(ma),一(yi)(yi)套人(ren)(ren)馬(ma)一(yi)(yi)套政(zheng)(zheng)績(ji)”,“前(qian)任不(bu)管后(hou)面(mian)洪(hong)水(shui)滔天(tian)”,“后(hou)任不(bu)管前(qian)任‘繁花(hua)錦簇’”,只編織(zhi)“自己的(de)一(yi)(yi)片天(tian)地”,最終導致了政(zheng)(zheng)府(fu)的(de)失(shi)(shi)(shi)信(xin)(xin)(xin),其他諸如(ru)政(zheng)(zheng)績(ji)治水(shui)、形象工程等,都是公務員失(shi)(shi)(shi)信(xin)(xin)(xin)的(de)現實寫照,并形成了極(ji)大(da)的(de)負面(mian)效應。故而,社(she)會(hui)誠信(xin)(xin)(xin)體(ti)系的(de)建設(she),必須以(yi)公務員誠信(xin)(xin)(xin)為重要(yao)內容的(de)政(zheng)(zheng)府(fu)公信(xin)(xin)(xin)為關(guan)鍵。時下的(de)誠信(xin)(xin)(xin)體(ti)系建設(she)不(bu)少,比(bi)如(ru)各個行(xing)業和領域實行(xing)的(de)“黑名單制度”,在實際(ji)中最終都淪(lun)為擺設(she),根本原因就(jiu)在于政(zheng)(zheng)府(fu)誠信(xin)(xin)(xin)沒有發揮作用,懲戒機制對(dui)政(zheng)(zheng)府(fu)失(shi)(shi)(shi)信(xin)(xin)(xin)約束失(shi)(shi)(shi)靈(ling)。

  有些難為公務員

  目(mu)前的(de)(de)社會(hui)(hui)誠(cheng)(cheng)信(xin)或征(zheng)信(xin)系(xi)統涉及的(de)(de)項目(mu)越來越多,除(chu)了公眾(zhong)熟知的(de)(de)信(xin)貸環節之外(wai),諸(zhu)如水、電、氣等(deng)民(min)生(sheng)項目(mu)欠(qian)費(fei)等(deng)也被一些地(di)方(fang)列入征(zheng)信(xin)系(xi)統中。據介紹,上海還將竊電、惡意欠(qian)費(fei)等(deng)納入征(zheng)信(xin)系(xi)統;湖南瀏陽則(ze)將欠(qian)稅賴賬(zhang)信(xin)息(xi)納入征(zheng)信(xin)系(xi)統……廣州市更(geng)是(shi)(shi)力爭在(zai)幾(ji)年(nian)后實(shi)現社會(hui)(hui)誠(cheng)(cheng)信(xin)體系(xi)的(de)(de)全覆蓋,這(zhe)都體現了國家(jia)和地(di)方(fang)有關(guan)方(fang)面對(dui)社會(hui)(hui)誠(cheng)(cheng)信(xin)建設的(de)(de)重視程(cheng)度(du)。然(ran)而,“征(zheng)信(xin)體系(xi)”是(shi)(shi)不是(shi)(shi)應(ying)該(gai)直接與公務員獎懲、提拔晉(jin)升等(deng)直接掛(gua)鉤,值得商榷。

  在社會(hui)誠信(xin)(xin)面前,不(bu)(bu)(bu)存在也(ye)不(bu)(bu)(bu)應該(gai)存在“特殊公(gong)(gong)(gong)(gong)民(min)”,無論任何人(ren)、什(shen)么官階,都應該(gai)一視同仁,就如銀行(xing)(xing)機(ji)構(gou)對于(yu)(yu)任何公(gong)(gong)(gong)(gong)民(min)的(de)(de)“不(bu)(bu)(bu)誠信(xin)(xin)”行(xing)(xing)為(wei)實(shi)施的(de)(de)“禁貸(dai)”懲(cheng)戒,可以適合于(yu)(yu)任何公(gong)(gong)(gong)(gong)民(min)。但另一方面,我們(men)也(ye)不(bu)(bu)(bu)應該(gai)單(dan)純“拔高(gao)”某(mou)一群體的(de)(de)“道(dao)德尺度”。公(gong)(gong)(gong)(gong)務(wu)(wu)(wu)員(yuan)也(ye)是人(ren),公(gong)(gong)(gong)(gong)務(wu)(wu)(wu)員(yuan)也(ye)會(hui)“不(bu)(bu)(bu)誠信(xin)(xin)”,科學合理(li)的(de)(de)做法是恰當(dang)(dang)區別公(gong)(gong)(gong)(gong)務(wu)(wu)(wu)員(yuan)群體“不(bu)(bu)(bu)誠信(xin)(xin)行(xing)(xing)為(wei)”的(de)(de)性(xing)質,針對不(bu)(bu)(bu)同性(xing)質的(de)(de)“不(bu)(bu)(bu)誠信(xin)(xin)”行(xing)(xing)為(wei)做出不(bu)(bu)(bu)同的(de)(de)處理(li)。換言(yan)之,公(gong)(gong)(gong)(gong)務(wu)(wu)(wu)員(yuan)在履行(xing)(xing)職(zhi)務(wu)(wu)(wu)時(shi)的(de)(de)不(bu)(bu)(bu)誠信(xin)(xin)可以與職(zhi)位升遷掛鉤(gou),而與職(zhi)務(wu)(wu)(wu)無關(guan)的(de)(de)公(gong)(gong)(gong)(gong)民(min)身份(fen)的(de)(de)“不(bu)(bu)(bu)誠信(xin)(xin)”行(xing)(xing)為(wei)應按照普通公(gong)(gong)(gong)(gong)民(min)對待。讓公(gong)(gong)(gong)(gong)務(wu)(wu)(wu)員(yuan)在履行(xing)(xing)職(zhi)務(wu)(wu)(wu)之外,當(dang)(dang)好(hao)家(jia)庭角色,當(dang)(dang)好(hao)丈夫、妻子(zi)、兒女,像普通人(ren)一樣看待他們(men)的(de)(de)“誠信(xin)(xin)”,有什(shen)么不(bu)(bu)(bu)好(hao)嗎(ma)? 畢曉哲

  建檔不能“自說自話”

  制度目的(de)(de)是好的(de)(de),現實中的(de)(de)操(cao)作究竟如何,恐(kong)怕還(huan)需要進一(yi)步完善和部(bu)署。根據(ju)《規(gui)劃(hua)》,公務員誠(cheng)(cheng)信(xin)檔(dang)案(an)的(de)(de)建(jian)立,管理部(bu)門(men)為政府部(bu)門(men),這也就意(yi)味著誠(cheng)(cheng)信(xin)檔(dang)案(an)如何建(jian)、怎么建(jian)都是由政府部(bu)門(men)主(zhu)導(dao)。那么,誠(cheng)(cheng)信(xin)檔(dang)案(an)建(jian)立的(de)(de)過(guo)程(cheng)中,會(hui)不會(hui)出現“避重就輕”或者“躲貓(mao)貓(mao)”的(de)(de)情(qing)(qing)形,令人深(shen)思(si)。更何況,人情(qing)(qing)關系羈絆下,相(xiang)關領導(dao)權力的(de)(de)滋擾下,是否會(hui)存在某(mou)些暗(an)箱操(cao)作的(de)(de)貓(mao)膩,也是值得思(si)考的(de)(de)問題。

  這種擔心并不多余,誠信(xin)(xin)(xin)(xin)檔案建立的(de)(de)話語(yu)權(quan)由公(gong)權(quan)部門掌握,外(wai)界公(gong)眾對于公(gong)務(wu)人員的(de)(de)具體誠信(xin)(xin)(xin)(xin)情況根(gen)本就無從知曉。公(gong)務(wu)員是否(fou)被懲罰,是否(fou)存在違(wei)(wei)法違(wei)(wei)紀現象,都屬于“內部”的(de)(de)操(cao)作。即(ji)便確有其事,誠信(xin)(xin)(xin)(xin)檔案中能否(fou)全部如實記載,就是另外(wai)一回事了。缺(que)乏外(wai)部的(de)(de)監督,屏蔽了誠信(xin)(xin)(xin)(xin)檔案所(suo)需要的(de)(de)“陽光”,誠信(xin)(xin)(xin)(xin)檔案的(de)(de)質量能否(fou)符合公(gong)眾預期(qi),還需要認真解決和考(kao)慮。

  假如能(neng)夠(gou)避免(mian)“自(zi)說自(zi)話”的(de)檔(dang)案構建模式,讓檔(dang)案的(de)誠信情況透明化,就(jiu)能(neng)為(wei)制度(du)的(de)運行提供有(you)力保障,從而產生預想中的(de)效(xiao)果和作用。
